This book has been written by Gazi Shamsur Rahaman and published from ‘Khoshroj Kitab Mahal’ in December 1985 for the first time. Where there is family, there is dispute, more or less- this is true. But such disputes sometimes take severe form, which leads to a chaos situation in the family as well as in the society. In order to resolve those problems within a legal framework, the Family Court Ordinance, 1985 was proclaimed. In That Ordinance it has been emphasized on resolving family issues on the basis of conciliation and peaceful manners, as family itself is a sophisticated matter and marriage is considered as sacred covenant under Muslim law, therefore nobody of the family can be bound to stay together under the same shadow. That’s why promulgating such a family law was a brave and strong step toward solving family disputes in a peaceful manners. However, some important features of the Family Court Ordinance, 1985 are- it can deal only certain matters, such as- dissolution of marriage, restitution of conjugal rights, dower, maintenance, and guardianship. Under this Ordinance a suit must be filled before the Assistant Judge’s Court and they will be treated as Family Court in this regard. Generally, a suit under this Ordinance will be filed in the Court under whose territorial jurisdiction cause of action arises or wife resides.
